Hvordan kunne banker i Europa og USA på stribe få lov til at satse egenkapitalen i ultrarisikable lån, uden at nogen greb ind? Hvorfor var der ingen, der advarede i tide? Hvordan kunne finanskrisen skylle ind over den vestlige verden, uden at de tilsyn, som netop er sat i verden for at holde øje med finansverdenen, for længst havde trukket i håndbremsen?

Spørgsmålene hober sig fortsat op – her omtrent et halvt år efter finanskrisen for alvor rullede ind på det europæiske kontinent. I går – 25. februar – afleverede tidligere direktør i Den Internationale Valutafond, Jacques de Larosière, en omfattende rapport til Europa-Kommissionen. En rapport, hvor Larosière både forsøger at svare på spørgsmålene og giver sit bud på, hvordan en finanskrise kan undgås i fremtiden. Medicinen er bedre koordinering og mere samarbejde af tilsynet med banker, forsikringsselskaber og finansmarkeder på tværs af landegrænserne.

Europa-Kommissionens formand, José Manuel Barroso, slog ved fremlæggelsen af rapporten fast, at det er strengt nødvendigt at handle.

”Vi må sikre en vedvarende tillid til den finansielle sektor i Europa. Denne rapport bekræfter, at et nyt europæisk system for tilsyn på det finansielle område er bydende nødvendigt. Jeg er parat til at indføre et sådan system,” fastslog Barroso.

Ny alarmcentral
Svaret i rapporten på hvorfor det gik galt, er, at et uhyre komplekst misk-mask af fejlende risikovurderinger, uigennemsigtige regler og finansprodukter samt et ukoordineret tilsyn på tværs af grænserne alt sammen bærer sin del af ansvaret for finanskrisen. Men der kan og skal rettes op, konkluderer rapporten.

Konkret foreslår Larosière oprettelsen af et helt nyt centralt europæisk organ – European Systemic Risk Council – ESRC. Det skal være en form for finansiel alarmcentral på europæisk plan, hvor man med snablen nede i oplysninger fra alle nationale finanstilsyn skal kunne overvåge og vurdere risici og ubalancer i finansverdenen. ESRC skal så trykke på den store røde alarmknap, så snart man ser problemer, så der kan handles langt tidligere, end tilfældet har været under denne finanskrise. Bankerne skal reddes lang tid før, det bliver nødvendigt at holde dem kunstigt i live med statslig kapital, er ambitionen hos Larosière.

Rapporten foreslår også et tættere og mere integreret samarbejde mellem de forskellige nationale finanstilsyn i Europa. En række europæiske storbanker agerer i dag i så mange forskellige lande, at det – f.eks. i sagen om den krakkede megabank Fortis i efteråret 2008 – har vist sig ekstremt svært at danne sig det nødvendige overblik over den samlede risiko og solvens. Både for bankens egen ledelse og så sandelig også for finanstilsynene. Derfor er det nødvendigt med bedre samarbejde og mere ensretning af tilsynsmyndighedernes arbejde i de enkelte lande. Det foreslår Larosière gjort ved at tilføre tre allerede eksisterende komiteer i EU-systemet flere muskler og flere beføjelser, når det handler om kontrol med de multinationale finanshuse og ensretning af regler og procedurer for tilsyn.

Nej til centralt tilsyn
Blandt andre Italien og Frankrig har presset på for et egentligt overnationalt finanstilsyn i Europa. Et forslag, som er blevet afvist af kansler Merkel i Tyskland og premierminister Brown i London, og som altså heller ikke ser ud til at blive til virkelighed.

På pressemødet onsdag redegjorde Larosière for sin anbefaling om at fastholde finanstilsynet nationalt, men med et styrket internationalt samarbejde og koordinering.

”Dét, vi har foreslået, er meget ambitiøst. Vi foreslår et kvantespring i de beføjelser, der skal gives til de tilsyn, som fremover vil eksistere. Men vi foreslår ikke systemer, der ikke vil have nogen chance for at fungere og blive accepteret politisk. Mængden af støv, der ligger på rapporter, er proportionalt med de urealistiske ambitioner, der nogle gange har været givet udtryk for,” sagde Larosière.

Allerede i næste uge – 4. marts – vil Kommissionen komme med sin vurdering af rapportens forslag. Men Barroso efterlod med gloser om rapporten som ”høj kvalitet”, ”afbalanceret” og ”berigende” ikke meget tvivl om, at Kommissionen givet vil gøre en stor del af anbefalingerne i rapporten til sine egne.

Aktionærforening tilfreds
Herhjemme har der været rejst kritik af det danske finanstilsyn af blandt andre Dansk Aktionærforening. Foreningen mener, at tilsynet har været alt for passivt og tilbageholdende med at lade informationer om investeringer og risiko i bankerne tilgå omverdenen. Direktør i Aktionærforeningen, Charlotte Lindholm, peger på, at der med Bankpakke II i Danmark allerede er strammet op over for Finanstilsynet. Men hun mener også, at øget internationalt samarbejde vil være et rigtigt skridt på vejen.

”Det er bestemt positivt, hvis samarbejdet med tilsynet i flere lande kan forbedres. Finansverdenen er blevet global, og mange virksomheder arbejder på tværs af grænser. Men når det er sagt, så tror jeg samtidig, at det kan blive en svær øvelse i praksis at sikre samarbejdet. For der er i dag meget stor forskel på, hvordan forskellige lande tolker regler og forpligtelser,” siger Charlotte Lindholm.

Til april afholdes der G20-møde i London, hvor verdens største økonomier fra både Vesten og Asien deltager. Inden mødet skal EU-landene have lagt en fælles linje i forhold til, hvordan man kan stramme op på kontrollen med den finansielle sektor.

Finanskrisen har sat fornyet fokus på behovet for et bedre tilsyn med banker og andre finansielle institutioner på tværs af landegrænser.

Ifølge tal fra Europa-Kommissionen er der over 8.000 banker i EU-landene. Men to tredjedele af de samlede aktiver ligger hos blot 44 multinationale finanshuse. Det er blandt andet muligheden for at forbedre kontrollen af disse multinationale selskaber, som diskuteres i EU.

Europa-Kommissionens formand, José Manuel Barroso, nedsatte i oktober 2008 en ekspertgruppe under ledelse af tidligere IMF-direktør, Jacques de Larosière. Ekspertgruppens opgave har været at komme med forslag til, hvordan man kan forstærke tilsynet med den finansielle sektor på tværs af grænserne i EU. Det handler blandt andet om at blive bedre til holde styr på risici og sikre, at krisesignaler opfanges i tide.

Den 25. februar præsenterede ekspertgruppen sine forslag for Kommissionen. Blandt forslagene er at oprette et nyt organ i forbindelse med Den Europæiske Centralbank. Det skal på et makroniveau danne sig et overblik over potentielle risici og ubalancer i den finansielle sektor og advare Kommissionen ved alvorlig fare. Samtidig foreslår rapporten at styrke samarbejdet mellem de nationale tilsyn og ensrette procedurer og regeltolkninger.

Kommissionen vil nu vurdere anbefalingerne frem mod det vigtige G20-møde den 2. april i London. G20-forumet, der indeholder en række af verdens største økonomier i både Vesten og Asien, blev oprettet i 1999 netop med baggrund i de finansielle kriser i Asien kort forinden.
